Official Contest Rules

CONTEST PERIOD

1. The KelownaNewParent Baby Photo Contest (the "Contest") is run by KelownaNewParent.com (the "Contest Sponsor and Administrator") and will take place in British Columbia, from 11:00:01 AM (PT) March 1, 2011 to 10:59:59 AM (PT) May 31, 2011 (the "Contest Period").

CONTEST GROUP ENTITIES

2. For the purposes of the Contest, the Contest Group Entities are KelownaNewParent.com, together with its suppliers of materials and services related to the Contest, or any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest (collectively, the "Contest Group Entities").

ELIGIBILITY

3. The Contest is open to individuals who are residents of British Columbia who have reached the age of majority in our province of residence as at the date of entering the Contest. Photos may not contain frontal nudity, obvious branding, or portray any situation or activity that may be deemed illegal, offensive, dangerous or inappropriate. Copy-written photos will not be accepted. It is the entrant’s responsibility to ensure they have permission to publish the photograph. KelownaNewParent.com reserves the right to approve or reject any photos. All decisions of the Contest’s panel of judges are final.

METHOD OF ENTRY

4. Entrants may register their entry by emailing their photograph directly to KelownaNewParent.com at kym@kelownanewparent.com. Alternatively you may upload your picture onto the KelownaNewParent.com Facebook page (http://www.facebook.com/KelownaNewParent). Please include parents name and baby’s name. Photos should be in jpg format. You may enter only one photograph per child per household. Multiple entries will be disqualified. Only one e-mail address may be used by any person to participate in the Contest. In the event of a dispute regarding the identity of an entrant, the entry will be deemed to have been submitted by the authorized holder of the e-mail address at the time of entry. For these purposes, the "authorized holder" is the natural person who is assigned to the submitted e-mail address by an Internet access or online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

PUBLISHING OF PHOTOS

5. All entrants agree to have their submissions published on the KelownaNewParent.com website in the Baby Contest Photo Gallery as well as on our Facebook page.

PRIZES AND WINNERS

6. There will be 3 monthly Fan favourite winners. Each month the picture with the most votes (either by pressing “LIKE” on Facebook or by emailing your vote to kym@kelownanewparent.com) will win a prize. Only 1 vote per person will be accepted. All monthly winners remain eligible for the 10 Grand Prize Packages.
MONTHLY PRIZES:

March: $25 Gift Certificate from Natural Belly and Baby
April: $30 Gift Certificate from Hands On Keepsakes
May: A Nursing Necklace from Mommy Jewels.

7. There will be ten (10) Baby Photo Grand Prize winners. 9 of the Winners will be chosen during the first week of June 2011 by a panel of Judges. The decisions of the Judges are final. The 10th Winner will be determined by voting. Only 1 vote per person will be accepted. To register your vote click “LIKE” on the picture on our Facebook page or if you are not on Facebook you can email your vote to kym@kelownanewparent.com. All winners names will then be placed in a draw to determine which prize they will receive.

A Monkey Doodle Swim Diaper provided by Tidy Tushees, a $25 Gift Certificate from Scallywags, a 20 g tin of Body Balm provided by Lalabee Bathworks baby products and toothpaste for baby.

TO BE DECLARED A WINNER

8. To be declared a winner of any Prize (a "Winner"), the selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with the official Contest rules, first:

Be reached by phone or email by the Sponsor or its representatives within the ten (10) days immediately following the selection of the entry;
Disqualification: If any one of the above mentioned conditions is not met, the selected entrant will be disqualified and shall not be entitled to receive any prizes. The Sponsor reserves the right, in its sole and absolute discretion, to select another eligible entrant as a potential prize winner.

GENERAL TERMS AND CONDITIONS

9. Verification of Entries: The validity of any Contest entry is subject to verification by the Sponsor. Any incomplete or fraudulent entries will be rejected. Any entrant or other individual who enters or attempts to enter the Contest in a manner which is contrary to these official Contest Rules or which is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be rejected and that entrant or purported entrant will be disqualified. All decisions of the Contest judges, who may be employees or independent contractors of the Sponsor and Contest Administrator, with respect to any and all aspects of the Contest, including without limitation the eligibility or disqualification of entrants or entries, are final and binding without right of appeal. The Sponsor reserves the right to remove photos without prior notice.
10. The Odds: The odds of winning depend upon the number of eligible baby photo entries received.
11. Acceptance of Prizes: All Prizes must be accepted as described in these rules and cannot be substituted for another prize or exchanged in whole or in part for money.
12. Substitution of Prizes: The Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute for any Prize, or part thereof, with a substitute prize of equivalent or greater value, including without limitation a cash award.
13. Release and Exclusion of Liability: By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Contest Group Entities, and their respective officers, directors, employees, shareholders, agents and other representatives (collectively, the "Releasees") from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest rules and acceptance and use of a Prize. The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Contest website during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
14. Name/Image of Winners: By entering the Contest, each winner agrees to abide by the Contest rules and authorizes the Sponsor and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use his or her name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration, including without limitation, on any website operated by or on behalf of the Contest Sponsor.
15. Personal Information: The personal information gathered about entrants in connection with this Contest will be used for the administration of this Contest, and may be shared with KelownnaNewParent.com Sponsors unless the entrants opt out in their initial email registration. If you wish to opt-out after the registration process, please email a written request, including your name, address and phone number to kym@kelownanewparent.com
